1.1 This policy explains when you can cancel, when you can get a refund, and how to go about it. It forms part of our Terms and Conditions.
1.2 The table below is a summary. The detail is in the sections that follow, and the detail is what applies.

2.1 Most of this policy describes rights that the law gives to consumers. You are a consumer if you are an individual buying wholly or mainly for your personal use rather than for your business.
2.2 If you are buying as a business, including as a sole trader buying for your drone business, the statutory rights described here do not apply to you. What applies instead is set out in section 9.
2.3 The statutory rights described in sections 3 to 8 apply to purchases made online, by telephone or by email. They come from the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015.
2.4 Nothing in this policy affects your legal rights.
3.1 When you buy from us online you normally have 14 days to change your mind, without giving a reason. This is called the cancellation period.
3.2 For services and for digital content, the 14 days run from the day after we accept your order. For goods, they run from the day after you, or someone you have nominated, receives the goods.
3.3 There are exceptions, and the most important one for us is that you can agree to give up this right in return for getting an online course immediately. Section 4 explains that in full.
3.4 To cancel, just tell us. Section 10 explains how.
Why we ask you to give up the 14 day right
4.1 Our online courses are made available to you as soon as you have paid. You can start watching the first lesson within a minute of checkout. That is deliberate, and it is what most people want.
4.2 The law allows us to give you immediate access on the condition that you agree to two things at the point of purchase: that you want us to start straight away, and that you understand you will lose your right to cancel once we do.
4.3 You are asked to confirm both by ticking a box at checkout. The exact wording is in Annex B. You cannot complete the purchase without ticking it, and we record the date and time you did.
What this means in practice
4.4 If you tick the box and we give you access, you no longer have a right to cancel and get your money back. This is the case even if you have not opened a single lesson.
4.5 If you do not tick the box, we cannot give you immediate access.
Goodwill refunds
4.7 We would rather have a happy customer than an unhappy one holding a course they do not want. So if something has gone wrong, tell us.
4.8 Any refund we offer once access has been granted is a goodwill gesture, made entirely at our discretion. It is not an admission that anything went wrong, it does not create any right to a refund in future, and it does not set a precedent for anyone else.
4.9 In deciding, we will normally look at how much of the course you have completed, how long ago you bought it, whether you have attempted an examination, and what the problem is. As a general guide, a request made within 14 days of purchase where you have completed less than 20% of the course is likely to be looked on favourably. That is a guide and not a promise.
4.10 Where we agree a goodwill refund, your access to the course, the community and anything else included with it ends on the day we refund you.
4.11 We will not offer a goodwill refund where a certificate has been issued, where an examination has been attempted, or where we have found malpractice.
Your statutory right
5.1 If you book an in-person course online, by telephone or by email, you have 14 days from the day after we confirm your place to cancel and receive a full refund. You do not need a reason.
5.2 This right applies regardless of how close the course date is. If you book a course that starts in nine days and cancel three days later, you are entitled to a full refund.
5.3 The only exception is where the course has already been delivered, in full, within that 14 day period at your express request. If a course runs during the cancellation period and you then cancel, we may charge you a proportionate amount for what was delivered before you cancelled.
Our cancellation terms once the 14 days have passed
5.4 After your statutory cancellation period has ended, the following applies. Notice periods are counted back from the first day of the course, and notice must be given in writing.

5.5 You may send someone else in your place instead of cancelling, provided they meet the entry conditions for the course and you tell us at least 7 days before it starts. There is no charge for a substitution.
5.6 Where a course price includes elements you have already used before you cancel, such as an online course released to you in advance of the classroom days, we may deduct the value of those elements from any refund. We will tell you the amount before we process it.
If we cancel or move a course
5.7 If we cancel a course, you can choose a place on the next available cohort or a full refund. If we move a course to a different date and you cannot make the new date, you can choose another cohort or a full refund.
5.8 If we move a course to a different venue and that makes it unreasonable for you to attend, the same choice applies.
5.9 We do not reimburse travel, accommodation or other costs you have incurred, so please do not book non refundable travel until we have confirmed the course is going ahead.
Your statutory right to change your mind
6.1 You have 14 days from the day you receive your equipment to tell us you have changed your mind. You then have a further 14 days to send it back.
6.2 You are entitled to handle and inspect the equipment as you reasonably would in a shop. Opening the box does not cost you your right to return it.
6.3 Doing more than that may cost you money. If the value of the equipment is reduced because you handled it more than was necessary to establish its nature, characteristics and functioning, we may deduct that reduction from your refund. In practice, that includes flying the aircraft outdoors, binding it to a user account, activating a subscription, applying stickers or an Operator ID label, and removing or discarding parts of the packaging that cannot be replaced.
6.4 We will always tell you the amount of any deduction and how we calculated it before we process your refund.
6.5 You pay the cost of returning the equipment to us. We recommend using a tracked and insured service, because the equipment remains your responsibility until it reaches us.
6.6 We refund the price you paid and the cost of standard outbound delivery. If you chose a faster or more expensive delivery option, we refund only up to the cost of our standard option.
Returns after the 14 days: our goodwill window
6.7 Beyond your statutory period we do not have to accept a return, but we usually will. As a goodwill gesture we will consider a return up to 30 days from delivery where the equipment is unused, unregistered, and in its original packaging in a condition we can resell.
6.8 Where we accept a goodwill return, we deduct a restocking charge of 10% of the price and we do not refund delivery. You pay the cost of returning it.
6.9 We will not accept a goodwill return of equipment that has been flown, bound to a user account, registered, modified, or is missing any part of what was supplied.
6.10 This window is a gesture and not a right. It does not affect your statutory rights, and it does not apply to faulty equipment, which is dealt with in section 8.
Equipment bought with training included
6.11 Where equipment is sold with a course included, cancelling the equipment order also cancels the course, because the course was supplied as part of the same package.
6.12 If you have already started the course, we may deduct a reasonable amount from your refund to reflect the training you have received. That amount will not be more than the price we charge for the same course bought on its own, and we will tell you how we have calculated it.
6.13 If you have not started the course, we simply withdraw access and make no deduction.
6.14 At checkout you will be asked to agree to immediate access to the training element in the same way as for any other online course. The wording is in Annex B.
7.1 You have 14 days from the day after we accept your booking to cancel and receive a full refund, unless the session has already been delivered within that period at your express request.
7.2 If a session is delivered during the cancellation period at your request and you then cancel, we may charge a proportionate amount for what was delivered.
7.3 Once the statutory period has ended, you may move a booked session free of charge if you give us at least 2 working days notice. With less notice, or if you do not attend, we may treat the session as delivered and no refund is due.
7.4 For an ongoing service such as an operations manual update service, you may cancel at any time and we will refund the unused portion, calculated to the nearest whole month.
8.1 This section is separate from everything above. It applies whether or not your cancellation period has ended, and nothing in this policy limits it.
8.2 Equipment. If equipment is faulty, not as described, or not fit for purpose, you can reject it and get a full refund within 30 days of delivery. After 30 days you can ask for a repair or a replacement, and if that is not possible, or does not fix the problem, you can claim a refund or a price reduction. In the first six months, a fault is presumed to have been there at delivery unless we can show otherwise.
8.3 Courses and digital content. Digital content must be of satisfactory quality, fit for purpose and as described. If it is not, you are entitled to a repair or replacement, and if that does not work, to a price reduction. If we supply something that damages your device or your data because we did not use reasonable care and skill, we must repair the damage or compensate you.
8.4 Services. Services must be carried out with reasonable care and skill, within a reasonable time, and for a reasonable price where no price was agreed. If they are not, you are entitled to have the service performed again or, if that is not possible, to a price reduction.
8.5 If you think something is wrong, contact us at hello@blueskiesdronetraining.com with your order number and a description of the problem. We do not charge for return postage on a faulty item.
8.6 You can get free, impartial advice about your rights from Citizens Advice at citizensadvice.org.uk or on 0808 223 1133.
9.1 If you buy as a business, you do not have the statutory cancellation rights described in this policy. The following applies instead.
9.2 Online courses. No refund once access has been granted.
9.3 In-person courses. The sliding scale in section 5 applies from the date of booking, and there is no cancellation period before it starts. Substitution of a delegate is free of charge on 7 days notice.
9.4 Equipment. We will consider a return within 30 days of delivery where the equipment is unused, unregistered and in resaleable condition in its original packaging. A restocking charge of 10% applies and delivery is not refunded. Equipment that has been opened and used is not returnable.
9.5 Consulting and advisory services. As set out in section 7, without the statutory cancellation period.
9.6 Your rights if something is faulty are set out in our Terms and Conditions.
10.1 Just tell us clearly that you want to cancel. Please include your name, your order number, what you are cancelling and the date.
10.2 By email: hello@blueskiesdronetraining.com. This is the quickest way and we will confirm receipt.
10.3 By post: Blue Skies Drone Training Ltd, Suite A, 82 James Carter Road, Mildenhall, Bury St Edmunds, IP28 7DE.
10.4 You can use the form in Annex A if you want to, but you do not have to.
10.5 To meet the deadline, it is enough that you send your message before the cancellation period expires. We will treat an email as sent on the day you sent it.
11.1 We refund to the payment method you used. If that is not possible we will agree another method with you. We do not charge a fee for making a refund.
11.2 Timing:
(a) for services and digital content, within 14 days of the day you told us you were cancelling;
(b) for goods, within 14 days of the day we receive them back from you, or if earlier, within 14 days of the day you give us evidence that you have sent them back;
(c) for a refund because of a fault, as soon as possible and in any event within 14 days of us agreeing that a refund is due.
11.3 Once we have processed a refund, how quickly it reaches you depends on your bank or card issuer, and that part is outside our control. It usually takes three to five working days.
11.4 Where a deduction applies, we will tell you the amount and the reason before we process the refund.
11.5 If you paid using an instalment or buy now pay later provider, we refund the provider and they adjust your agreement with them.
12.1 If you think a payment is wrong, please talk to us first. We will almost always sort it out faster than your bank can.
12.2 Raising a chargeback while we are dealing with your request does not speed anything up, and where a chargeback is raised for a course that has been accessed or a certificate that has been issued we will defend it with the evidence we hold, including the record of your consent at checkout.
13.1 If you are unhappy with a decision we have made under this policy, email hello@blueskiesdronetraining.com. We will acknowledge within 5 working days and respond fully within 20 working days.
13.2 Section 32 of our Terms and Conditions explains what happens next, including alternative dispute resolution.
14.1 Nothing in this policy affects your legal rights. Where anything in it appears to conflict with a right the law gives you, your legal right applies.
14.2 This policy is governed by the law of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may bring proceedings in your own country.
You do not have to use this form. You can cancel by any clear statement. It is here because the law requires us to make it available.
